RULES & REGULATIONS

NO PURCHASE NECESSARY. SEARCH CONTEST IS VOID IN WHOLE OR PART WHERE PROHIBITED BY LAW. SEE ELIGIBILITY SECTION BELOW FOR FURTHER DETAILS. TO COMPLETE YOUR ENTRY YOU MUST READ AND AGREE TO THE FOLLOWING TERMS. PARTICIPATION IN THIS SEARCH CONTEST CONSTITUTES FULL AND UNCONDITIONAL AGREEMENT AND ACCEPTANCE OF THESE SEARCH CONTEST RULES. ALL DOLLAR AMOUNTS ARE IN CANADIAN FUNDS ($CDN) UNLESS OTHERWISE NOTED.  THE SEARCH CONTEST IS CONDUCTED BY VANCOUVER CANUCKS LIMITED PARTNERSHIP (“VCLP”)

(1)        THE SEARCH:  The search is on for a charismatic Canucks fan who knows how to whip a crowd into a wild frenzy. The Vancouver Canucks are looking for your video submission (one minute or less) that demonstrates how you would get 18,000 + fans cheering, chanting, clapping and stomping at every home game.

The winner will be a natural performer who knows how to motivate fans to get loud, support the team, psych-out the opponents and have more fun at games.

WARNING:  You must comply with these outlined rules & regulations and user rules of the site (YouTube) to which you upload your entry.  Importantly, you must not do anything in connection with creating your entity which might cause danger of any kind to yourself or any other person or property.  An entry which, in VCLP’s opinion, may have constituted in its making any danger of such kind will be disqualified from the Search.  Don’t take risks—you can’t win if you do.

(2)        SEARCH PERIOD: The Search begins at 09:00AM Pacific Standard Time ("PST") on Friday, January 18th, and ends 07:00PM Pacific Standard Time (“PST”) on Saturday March, 15th  2008.

(3)        ELIGIBILITY

a.         Must be 18 years of age or older

Entrants are not eligible to participate in the Search if they are:

b.         owners, governors, officers, directors, partners, partnerships, principals, employees, agents, and representatives of VCLP, Vancouver Arena Limited Partnership “VALP”, or it’s related entities, or

c.         a member of the household and/or immediate family of any of the above parties. For the purpose of the Search Rules, "immediate family" means husband, wife, spouse, mother, father, brother, sister, son and/or daughter, whether or not they reside in the same household.

d.         VCLP shall have the right at any time to require proof of identity and/or eligibility to participate in the Search. Failure to provide such proof may result in disqualification. All personal and other information requested by and supplied to VCLP for the purpose of the Search must be truthful, complete, accurate and in no way misleading. VCLP reserve the right to disqualify any entry or entrant in its and their sole discretion, should any entry or entrant at any stage contain and/or supply untruthful, incomplete, inaccurate or misleading personal details and/or information.

(4)        HOW TO ENTER

a.         There is no purchase necessary to enter. To enter your video audition submission, go to http://www.youtube.com/group/ultimatecanucks (“Web Site”). If you are not an existing Youtube user, you will be required to agree to the YouTube Terms and Conditions of Use, located on http://www.youtube.com/t/terms and create a free YouTube account in order to submit a video in the search (a “Search ID”). Once registered with YouTube, join the YouTube group associated with the Ultimate Canucks Search (the "Search Group") by clicking the "Join This Group" link from the Search Group page. When you have successfully joined the Search Group, click "Upload Your Video" and follow the instructions to upload your video (your "Submission") to your YouTube account.

c.         By uploading a Submission in the Search, the entrant represents and warrants that the Submission is suitable for display and publication on Canucks.com and that (i) the Submission does not contain any material that is libelous, defamatory, profane, obscene or indecent, including but not limited to nudity or profanity; it must not contain defamatory statements (including but not limited to words or symbols that are widely considered offensive to individuals of a certain race, ethnicity, religion, sexual orientation or socioeconomic group), it must not include threats to any person, place, business, group or world peace, it must not invade privacy or other rights of any person, firm or entity, and it must not in any other way violate applicable laws and regulations  (ii) the Video is original to the entrant, and all right, title, and interest (including copyright) therein and thereto is owned and/or controlled by the entrant to the full extent necessary to enable VCLP to use the material entered as contemplated herein; and (iii) the Video does not infringe upon the intellectual property or other statutory or common law rights of any third party.

d.         Limit: Each participant may enter only one video audition submission. Video submissions must be one minute in length or shorter.

            Multiple Participants are not permitted to share the same email address.

e.         Entries received through YouTube shall be deemed to be submitted by the authorized account holder of the e-mail address associated with the Entry. For the purpose of the Search Rules, "authorized account holder" of an e-mail address means the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider, or other organization responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Potential winner may be required to provide VCLP with proof that the potential winner is the authorized account holder of the e-mail address associated with the winning Entry, or the agreement of the authorized account holder that the winner may be recognized by VCLP as the originator of the entry.

(5)        JUDGING/REQUIREMENTS OF CONTEST WINNERS: Entrants, must submit a video audition tape, consisting of no more than 3 “crowd pumpers” and running no longer than a minute in length, by approx. 10:00AM PST on March 1, 2008.  From the entries, a panel of judges will select approx 20 entrants to come to General Motors Place in Vancouver, British Columbia, at 10:00AM on March 15, 2008, to perform before another panel of judges chosen by VCLP in its sole discretion (the "Judges"). The Judges will choose 4 Finalists from this group. The finalists will then compete against each other live in front of fans over the course of three selected Vancouver Canucks home games. The Judges, at their sole discretion, retain the right NOT to select a finalist(s).

Grand Prize winners will be notified by email and/or phone on or about April 3rd, 2008  by VCLP.

The winner must comply with all contest rules as published. In the event of a tie for the Grand Prize, the judging panel will consider factors such as the YouTube standings, entertainment value and decide who will win the prize.

(6)        PUBLICITY RELEASE AND RELEASE OF LIABILITY

Winner Release. The Winner agrees to sign and return a publicity release and release of liability (the "Winner Release") which confirms, among other things, that the Grand Prize Winner: (i) releases Vancouver Canucks Limited Partnership, General Motors Place, the Vancouver Canucks, the National Hockey League ("NHL"), the member clubs of the NHL, NHL Enterprises Canada Inc., the NHLPA and current and former NHL players, its and their respective affiliates, subsidiaries, related companies, and its and their respective directors, officers, shareholders, owners, partners, representatives, employees, agents, successors and assigns from any and all liability arising out of or in any way connected to his or her participation in the Search, participation in any Search-related activity, the use of his/her Video contemplated herein, and/or the use of personal information described herein, including but not limited to costs, injuries, losses or damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light, or from any and all claims of third parties arising therefrom; (ii) grants to VCLP and/or its and their agents the unrestricted right for any purpose to produce, reproduce, publish, broadcast, communicate by telecommunication, exhibit, distribute, adapt and otherwise use or re-use the entrant's Video, address and city/province of residence, statements, endorsements, biography, name, voice, photograph and likeness for advertising and/or publicity purposes, without compensation, in any and all media now known or hereafter devised; and (iii) expressly waives, to the fullest extent permitted by law, any so-called "moral rights" which may now or may hereafter be recognized by legislative enactment or otherwise at law or in equity with respect to the Submission. The executed Grand Prize Winner Release must be returned by April 20, 2008 or the selected eligible entrant shall be disqualified.

(7)        PRIZES:

Contract employment with the Vancouver Canucks for the 2007.08 playoffs. Winners will be subject to the terms and conditions set forth in their employment agreement.

b.         The winner may claim their prize at General Motors Place located at 800 Griffiths Way, Vancouver, BC seven (7) days after he/she has been successfully contacted and notified of his/her Prize, has complied with the Search Rules and has signed and returned the Finalist Release (outlined in section 6).

(8)        CONDITIONS OF PARTICIPATION

By participating in this Search and uploading a video audition submission, the entrant:

a.         agrees to be bound by these Search Rules;

b.         agrees to be bound by the decisions of VCLP and the Judges, which shall be final and binding in all respects;

c.         agrees to sign and return Grand Prize Winner Release, as applicable; and

d.         grants to VCLP and/or its and their agents the unrestricted right for any purpose to produce, reproduce, publish, broadcast, communicate by telecommunication, exhibit, edit, distribute, adapt and otherwise use or re-use his/her Video or photograph Submission, without compensation, in any and all media now known or hereafter devised.

e.         Warrants and represents that the entrant owns all rights to the Submission he/she is entering in this contest, including, without limitation, the video or digital recording, and the performance contained in each Submission.

f.          Warrants and represents that the entrant is the individual pictured and heard in the Submission, or, alternatively, that the entrant has obtained permission from each person who appears in the Submission to grant the rights to the Search parties described in these rules and can make written copies of such permissions available to the contest parties upon request.

(9)        LIMITATION OF LIABILITY

VCLP is not responsible or liable for late, lost, incomplete, illegible, misdirected, stolen, delayed, damaged or destroyed entries, notifications, replies or any Release; for lost, interrupted, inaccessible or unavailable networks, servers, Internet Service Providers, websites or other connection, related to the Search and/or the Search Website; for errors of any kind, including but not limited to human, electronic, mechanical and/or technical in nature; for failure or technical malfunction of any telephone network or lines, computer and online systems, servers, computer equipment, software, e-mail, players, or browsers on account of technical problems or traffic congestion on the Internet, the Search Website, any related website, or any combination thereof; for any injury or damage to entrant, entrant's computer, or any other person's computer related to or resulting from participating in, or downloading material in connection with the Search; for incorrect or inaccurate information; for weather conditions, event cancellations, delay or rescheduling or other factors beyond VCLP’s control.

(10)      DISQUALIFICATION

VCLP reserve the right, in its and their sole discretion, to disqualify any entrant who is found to be tampering with the entry process or with the operation and administration of the Search; acting in an unsportsmanlike or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Search; or in violation of the Search Rules. VCLP reserve the right to seek damages and other remedies from any such entrant to the fullest extent permitted by law, including but not limited to criminal prosecution.

REMINDER:  Entrants must comply with the user rules of the site (YouTube.com) to which you upload your entry.  Importantly, you must not do anything in connection with creating your entity which might cause danger of any kind to yourself or any other person or property.  An entry which, in VCLP’s opinion, may have constituted in its making any danger of such kind will be disqualified from the Search.  Don’t take risks—you can’t win if you do.

(11)      USE OF PERSONAL INFORMATION

By participating in the Search, the entrant consents to the collection, use and disclosure of his/her personal information by VCLP for the purpose of administering the Search, awarding the Finalist Prizes as applicable. Personal information collected in connection with the Search will be used by VCLP in accordance with VCLP’s privacy policy available at www.canucks.com

 

(12)      INTELLECTUAL PROPERTY

All intellectual property, including but not limited to trade-marks, trade names, designs, promotional materials, web pages, source code, drawings, illustrations, logos, slogans and representations are owned by VCLP and/or their affiliates. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited. Entrants may use the jersey insignia of the Vancouver Canucks, and other designs owned by VCLP associated with the Vancouver Canucks only for the purpose of entering the Search and not for any other purpose.

 

(13)      GOVERNING LAW

The Search is subject to applicable federal, provincial and municipal laws and regulations and is void where prohibited by law. All issues and questions concerning the construction, validity, interpretation and enforceability of the Search Rules or the rights and obligations as between the entrant and VCLP in connection with the Search shall be governed by and construed in accordance with the laws of the province of British Columbia including procedural provisions without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction's laws.

 

(14)      OFFICIAL RULES

These Search Rules will be available at the Vancouver Canucks reception desk (Gate #5) located at General Motors Place, 800 Griffiths Way, Vancouver, BC, V6B 6G1 and posted online at the Search Website throughout the Search Period.

 

Use of Canucks logos, photos, art, audio and video (as included in the 'EXTRAS' area of the site) are only authorized by VCLP for use in the production of Ultimate Canucks Search submissions and for no other purpose. Any Ultimate Canucks Search submission which includes the use of the Canucks logo cannot be used for any other purposes without the express written consent of VCLP.

VCLP expressively reserves the right to revoke this limited license at any time for any reason.
